10. Your privacy rights

You acknowledge that this Privacy Policy is part of our website Terms of Use, and by accessing or using the Services (including the App and In-Store Devices), you agree to be bound by all of its terms and conditions. If you do not agree to these terms, please do not access or use the Services.

We reserve the right to change this Privacy Policy at any time. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to issuing an e-mail to the e-mail address listed by registered users or posting the revised Policy on this page. You acknowledge and agree that it is your responsibility to maintain a valid e-mail address as a registered user, review this site and this Policy periodically and to be aware of any modifications. Your continued use of the Services after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by the modified Policy.

1. What information do we collect from you?

In order to better provide you with our Services, we collect two types of information about our users: Personally Identifiable Information and Non-Personally Identifiable Information. Our primary goal in collecting information from you is to provide you with a smooth, efficient, and customized experience while using the Services.

Personally Identifiable Information: This refers to information that lets us know the specifics of who you are. For customers this may include without limitation your first and last name, an optional nickname, email address, phone number, delivery and billing addresses, your order history, your preferred payment method and, if you choose to pay by card, your card type, card number and expiration date. We never store your card security code (CVV).

For Merchants who register a restaurant or apply to accept payments through Orderzone, we may also collect the legal and “doing business as” (DBA) name of the business, a business email address (which may be the same as your login email), the contact person’s name and phone number, the business and mailing addresses, the business start date, and, where required by our payment processing partners to open a merchant account, the owner’s date of birth, ownership percentage, Social Security number, driver’s license number and bank account details for payouts. Merchants may also create referral codes, and we record which Merchant referred a new applicant.

Non-Personally Identifiable Information: This refers to information that does not by itself identify a specific individual. We gather certain information about you based upon where you visit on our site in several ways. This information is compiled and analyzed on both a personal and an aggregated basis. This information may include the site’s Uniform Resource Locator (“URL”) that you just came from, which URL you go to next, what browser you are using, what type of device you are using, your Internet Protocol (“IP”) address, and your approximate location derived from your IP address or the ZIP code you enter. If you allow it in your browser or device, we may also use your precise location to show restaurants near you; you may decline this and search by address or ZIP code instead.

Orders placed on In-Store Devices are anonymous unless you choose to provide your name, phone number or email for order pickup or receipts; card payments on In-Store Devices are handled directly by the restaurant’s payment terminal and card details are not transmitted to Orderzone.

2. Where do we collect information from you and how do we use it?

We do not collect any Personally Identifiable Information about you unless you voluntarily provide it to us. You provide certain Personally Identifiable Information to us when you:

  1. Register for a user account (only an email address and password are required; you may add your name, nickname, phone number and addresses later or at checkout);
  2. Verify your email address through the link we send you;
  3. Place orders or request deliveries through our platform, including when you ask us to remember your payment method for next time;
  4. Register a restaurant, submit a merchant application, or use a referral code;
  5. Sign up for special offers; or
  6. Send e-mail messages, submit contact forms or transmit other information on or through the Services.

In addition, we may also collect, or our third party service providers may collect, certain Non-Personally Identifiable Information. We use your IP address to diagnose problems with our servers and software, to administer our site and to gather demographic information. To protect the Services from automated abuse, our registration, merchant sign-up and contact forms are protected by Google reCAPTCHA, and we keep a log of merchant registration attempts (email address, IP address, browser type and outcome) and limit how often verification emails can be requested.

We will use your Personally Identifiable Information to provide our Services to you. For example, we will use your payment and physical address to process your requests for food delivery or pickup, and we will use your remembered payment method and saved card to pre-fill your next checkout so you only need to enter the card security code. We send transactional communications that are necessary to provide the Services, such as email verification links, order confirmations and order status updates by email and, if you provide a mobile number, by text message (SMS). We use Merchant application information to set up the Merchant’s account and to establish payment processing and payouts with our payment partners. We will also use Personally Identifiable Information to enhance the operation of the Services, fill orders with local restaurants, improve our marketing and promotional efforts, statistically analyze use of the Services, improve our product and service offerings, and customize the content, layout, and services we show you. We may use Personally Identifiable Information to deliver information to you and to contact you regarding administrative notices and regarding product or service offerings which we believe may be of interest to you. You will be given an opportunity to opt out of receiving promotional materials from us. We may also use Personally Identifiable Information to assist in dispute resolution, troubleshoot problems and enforce our agreements with you, including our Site Terms of Use and this Privacy Policy. While you may opt-out of receiving our promotional communications by taking the measures outlined in such communications, you may not opt-out of receiving administrative communications.

3. With whom do we share your information?

We do not sell, trade, or rent your Personally Identifiable Information to others. We may utilize the services of third parties and provide some of our Services through contractual arrangements with affiliates, service providers, partners and other third parties, and to facilitate such arrangements we reserve the right to share with such third parties Personally Identifiable Information, provided that such third parties agree to not share the information. In particular:

  • Restaurants. When you place an order, we share your name, contact details, delivery address, order details and, where the restaurant charges you directly, your payment card information with the restaurant fulfilling the order so that it can prepare, deliver and charge you for your particular order.
  • Payment processors. Card payments are processed by third party payment processors selected by us or by the restaurant (which may include Valor PayTech, Stripe, Authorize.Net, PayPal, Braintree, Converge, USAePay and Dejavoo). We share the payment information needed to complete your transaction with the applicable processor. Merchant application information, including owner identification and bank account details, is shared with the payment processor and its sponsoring bank to open and underwrite the Merchant’s account.
  • Google. We use Google reCAPTCHA to protect our forms, Google Maps and Places to suggest and validate addresses and to show restaurant locations, and Google Analytics to understand how the Services are used. These services collect device and usage information, including your IP address, and the address text you type into an address field is sent to Google to return suggestions. Their use is subject to the Google Privacy Policy and Terms of Service.
  • Communications providers. We use third party email delivery and SMS providers (such as Twilio) to send verification, order and notification messages, and we share your email address or mobile number with them for that purpose.
  • Hosting and infrastructure providers that store and process data on our behalf.

Occasionally we may be required by law enforcement or judicial authorities to provide Personally Identifiable Information to the appropriate governmental authorities. We will disclose Personally Identifiable Information upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our Services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

We may also provide Non-Personally Identifiable Information about our customers’ traffic patterns, and related site information to third party advertisers, but these statistics do not include Personally Identifiable Information.

4. How can you update, correct or delete your Personally Identifiable Information?

We believe you should have the ability to access and edit the Personally Identifiable Information that you have provided to us. You may change any of your Personally Identifiable Information in your account online at any time by logging on to your account and editing your information. You can change or replace your remembered payment method and saved card at checkout at any time, and you may ask us to remove a saved card from your account.

We encourage you to promptly update your Personally Identifiable Information if it changes. You may ask to have your account and the information on it deleted or removed by contacting us at the address below; however, because we keep track of past transactions, you cannot delete information associated with past transactions on the Services, and we may retain information where required for tax, accounting, fraud prevention or legal purposes. In addition, it may be impossible to completely delete your information without some residual information because of backups.

5. What are your choices regarding collection, use, and distribution of your information?

We may, from time to time, send you e-mail regarding our Services or about the services of affiliates or marketing/advertising partners. In addition, we may occasionally send you direct mail (including e-mail) about products and services that we feel may be of interest to you, such as offers from various local restaurants. You will have the ability to opt out of receiving such communications from us by following the instructions in such communications. You can stop receiving text messages by replying STOP to any message or by removing your mobile number from your account. You can decline location access in your browser or device settings, and you can decline cookies as described below, although some parts of the Services may not work properly in that case.

6. What security precautions are in place to protect against the loss, misuse, or alteration of your information?

The importance of security for all Personally Identifiable Information associated with our users is of utmost concern to us. Your Personally Identifiable Information is protected in several ways. Access to your account is protected by your email address and a password selected by you; passwords are stored in hashed form and cannot be read by our staff. We recommend that you do not divulge your password to anyone. Saved payment card numbers, Merchant owners’ Social Security and driver’s license numbers and bank account numbers are encrypted at rest, and card security codes (CVV) are never stored. Information is transmitted to us over encrypted (HTTPS) connections and resides on secure servers that only our selected personnel and contractors have access to; administrative access to the platform is protected by two-factor authentication.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personally Identifiable Information, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through the Services cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.

7. Do we use “cookies”?

When you use our site or App we may store cookies on your computer or device in order to facilitate and customize your use of the Services. A cookie is a small data text file, which a website stores on your device that can later be retrieved to identify you to us. We use cookies to keep you signed in, to remember your cart and your session, and to help us maintain a secure site. Google Analytics and Google reCAPTCHA also set cookies on our site in order to measure usage and to distinguish people from automated traffic. You are always free to decline our cookies if your browser permits, but some parts of the Services may not work properly in that case.

8. What should you know about privacy policies and data collection at any third party sites accessible from our Services?

Our site and/or App may feature links to third parties, such as the websites of local restaurants, and may include content and tools provided by third parties such as Google. Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Other sites and services accessible through the Services have their own privacy policies and data collection, use and disclosure practices. Please consult each site’s privacy policy.

9. Children’s privacy

The Services are not directed to children under the age of 13, and we do not knowingly collect Personally Identifiable Information from children under 13. If you believe a child under 13 has provided us with Personally Identifiable Information, please contact us and we will delete it.

10. Your privacy rights

Depending on where you live, you may have the right to request access to the Personally Identifiable Information we hold about you, to have it corrected or deleted, and to learn how it has been shared. California residents may also have rights under the California Consumer Privacy Act. To exercise any of these rights, please contact us using the details below. We will verify your identity before acting on your request and will not discriminate against you for exercising your rights.

If you have any questions about this Privacy Policy, the practices of the Services, or your dealings with us, please contact us by sending an email to admin@orderzone.net or by calling +1 (951) 234-7777.

This Privacy Policy is effective as of 10/26/2026 and replaces the version dated 1/18/2021.
